Terms & Conditions

These Terms and Conditions govern your use of Canal Club Copenhagen's services and booking platform. By making a reservation, you agree to these terms in full.

Company Information

Canal Club Copenhagen ("Canal Club", "we", "us", or "our") operates curated private and semi-private boat experiences on the canals and harbour of Copenhagen, Denmark.

Definitions

The following definitions apply throughout these Terms and Conditions:

  • Booking - a confirmed reservation for a Canal Club experience, evidenced by a written confirmation from us.
  • Experience - any service, tour, charter, cruise, or event offered and operated by Canal Club Copenhagen.
  • Guest - any person who participates in a Canal Club experience, whether or not they made the booking.
  • Lead Booker - the person who makes and is legally responsible for a booking, including on behalf of all guests in their party.
  • Captain - the qualified and certified vessel operator assigned to an experience.
  • Force Majeure - circumstances beyond Canal Club's reasonable control, including but not limited to extreme weather, mechanical failure, acts of God, pandemics, port authority restrictions, or government directives.

Acceptance of Terms

By making a booking with Canal Club Copenhagen - whether through our website, booking platform, by telephone, or by email - you confirm that you have read, understood, and agreed to these Terms and Conditions in full, on behalf of yourself and all guests included in your booking.

If you do not agree with any part of these Terms and Conditions, you must not complete a booking.

These Terms and Conditions constitute the entire agreement between you and Canal Club Copenhagen with respect to the booking and experience. They supersede all prior representations, agreements, or understandings, whether oral or written.

Our Services

Canal Club Copenhagen offers curated private and semi-private boat experiences on Copenhagen's canals, inner harbour, and surrounding waterways. Our experiences include, but are not limited to:

  • Sunset Sessions - evening cruises designed around golden-hour atmosphere
  • Romantic Escape - intimate couples experiences on the water
  • Morning Cruise - calm harbour exploration in the early hours
  • Full Day Experience - extended curated day on the water
  • Private Experience & Custom Charters - bespoke experiences for private groups, events, and occasions

Full details, inclusions, routes, durations, and pricing for each experience are described on our website and booking platform. Canal Club reserves the right to modify route details, itineraries, and ancillary inclusions at its discretion, provided that the overall standard and nature of the experience is maintained.

Booking & Reservations

All bookings must be made through our official booking platform at booking.canalclub.dk, by emailing concierge@canalclub.dk, or by calling +45 31 51 04 44.

A booking is not confirmed until we have received the applicable payment or deposit and you have received a written confirmation from us. Verbal confirmations do not constitute a binding reservation.

The Lead Booker is responsible for ensuring that all guests in their party are informed of and agree to these Terms and Conditions. By completing a booking, the Lead Booker represents that they have the authority to act on behalf of all guests included in the booking.

Canal Club Copenhagen reserves the right to decline or cancel any booking at its sole discretion, including where we have reason to believe these Terms and Conditions may be violated.

Pricing & Payment

All prices are quoted in Danish Krone (DKK) and include applicable Danish VAT (25%) unless otherwise stated.

For standard experiences, full payment is required at the time of booking to secure your reservation.

For private charter experiences, custom events, and bookings with negotiated pricing, we may require a deposit of 50% at the time of booking, with the remaining balance due no later than 7 days before the scheduled experience date. Failure to pay the balance by the due date may result in cancellation of the booking.

We accept major credit and debit cards through our secure third-party booking platform. Payment by MobilePay or bank transfer may be arranged by prior agreement with Canal Club Copenhagen.

Prices displayed on our website are subject to change without prior notice. The price applicable to your booking is the price confirmed to you in your booking confirmation.

Cancellation Policy

7.1 - Cancellations by the Guest

Our cancellation policy is as follows:

  • More than 7 days before the experience: Full refund, less a 5% administration fee.
  • 3-7 days before the experience: 50% refund of the total booking value.
  • 48-72 hours before the experience: 25% refund of the total booking value.
  • Less than 48 hours before the experience: No refund. The full booking amount is forfeited.
  • No-show: No refund. Failure to appear at the agreed departure point and time constitutes a no-show.

7.2 - How to Cancel

To cancel a booking, you must contact us in writing by email at concierge@canalclub.dk, clearly stating your booking reference and the names of the guests. Cancellations are effective from the date and time we acknowledge your written cancellation request. Verbal cancellations are not accepted.

7.3 - Refund Processing

Refunds will be processed to the original payment method within 5-10 business days of the cancellation being confirmed. Canal Club is not responsible for any delays caused by banking or payment processing institutions.

Canal Club Copenhagen strongly recommends that all guests take out appropriate travel insurance to cover against cancellation costs and other unforeseen expenses.

Rescheduling

Guests may request to reschedule a booking, subject to availability, without penalty if the request is made at least 48 hours before the scheduled experience date.

Rescheduling requests made less than 48 hours before the experience are subject to availability and may incur a rescheduling fee of DKK 200 per booking.

Bookings may not be rescheduled more than twice. A third rescheduling request will be treated as a cancellation subject to the cancellation policy in Section 7.

Rescheduled experiences must take place within 12 months of the original booking date. After this period, the booking will be cancelled and no refund will be issued.

Cancellations by Canal Club

Canal Club Copenhagen reserves the right to cancel or postpone an experience due to any of the following:

  • Unsafe weather conditions or forecasts as assessed by the Captain
  • Mechanical failure or technical issues with the vessel
  • Force Majeure events beyond our control
  • Failure to meet the minimum guest requirement (where applicable)
  • Safety concerns assessed by the Captain or Canal Club management
  • Port authority, harbour master, or government restrictions

In the event of a cancellation by Canal Club Copenhagen, guests will be offered the choice of either:

  • A full refund of all amounts paid; or
  • The option to reschedule the experience to a mutually available date at no additional charge.

Canal Club Copenhagen's liability in the event of a cancellation initiated by us is strictly limited to refunding the amounts paid. We shall not be liable for any additional costs incurred by guests as a result of our cancellation, including but not limited to travel, accommodation, transport, or other ancillary expenses.

Weather Policy

Canal Club Copenhagen operates in outdoor marine environments, and weather conditions in Copenhagen can be variable and unpredictable. Our experiences are designed to operate in a wide range of conditions, including light rain and overcast skies, which are a natural part of the authentic Copenhagen experience.

The final decision on whether an experience will proceed in adverse or uncertain weather conditions rests solely and exclusively with the Captain, in consultation with Canal Club management. This decision will be made on the day of the experience, and will take into account the safety of all guests and crew, applicable maritime weather guidelines, and current and forecast conditions.

If an experience is cancelled or significantly curtailed due to severe weather conditions determined to be unsafe by the Captain, guests will be offered a reschedule or a full refund in accordance with Section 9.

Light rain, overcast conditions, reduced sunshine, or reduced visibility that do not constitute a safety risk are not grounds for a refund, cancellation, or complaint. Guests are encouraged to dress appropriately for the weather and to bring suitable clothing for changeable Nordic conditions.

Minimum Guest Requirements

Some Canal Club experiences operate with a minimum number of guests required for the experience to proceed as scheduled. Where a minimum applies, this will be stated in the experience description on our booking platform.

If the minimum number of guests is not met for a particular departure and we are unable to combine your booking with another group, we will contact you at least 24 hours in advance of the scheduled departure and offer you either a full refund or the option to reschedule at no additional cost.

Private charters and fully private bookings are not subject to minimum guest requirements.

Age Requirements & Guest Eligibility

Guests under the age of 18 must be accompanied by a parent or legal guardian at all times throughout the duration of the experience.

Children under the age of 12 are required to wear a life jacket at all times while on board. Life jackets in a range of appropriate sizes are available on board at no additional charge.

Canal Club Copenhagen reserves the right to refuse boarding to any guest who appears to be intoxicated, under the influence of illegal substances, or whose behaviour or condition poses a risk to the safety or enjoyment of others on board.

Guests with mobility limitations, medical conditions, physical disabilities, or health considerations that may affect their safety or comfort on board are encouraged to contact us before making a booking to discuss suitability, accessibility, and any accommodations we are able to provide.

Canal Club Copenhagen does not discriminate on the basis of age, disability, or other protected characteristics, and will endeavour to accommodate all guests to the best of our ability within the constraints of maritime safety requirements.

Health & Safety

The safety and wellbeing of our guests and crew is the highest priority for Canal Club Copenhagen. All Canal Club vessels are maintained and operated in full compliance with applicable Danish maritime regulations and carry all required safety equipment, including Coast Guard-approved life jackets, first aid equipment, and emergency communication devices.

All guests are required to follow all safety instructions and directions given by the Captain and crew at all times during the experience. Failure to comply with safety instructions constitutes a material breach of these Terms and Conditions and may result in immediate termination of the experience without any refund.

Guests must remain seated while the vessel is in motion unless expressly instructed otherwise by the Captain or crew.

Swimming from the vessel is only permitted in designated areas and only with the express permission and direct supervision of the Captain.

Guests must not bring their own alcohol on board unless prior written agreement has been made with Canal Club Copenhagen management.

Captain's Authority

The Captain of the vessel holds full and absolute authority over the operation and navigation of the boat, the safety and welfare of all guests and crew, and the overall management of the experience at all times.

The Captain may, at their sole and unfettered discretion, alter the planned route, curtail or cut short the experience, return to shore earlier than scheduled, refuse boarding to any guest, or remove any guest from the vessel, if at any time they deem it necessary on the grounds of safety, weather conditions, mechanical concerns, guest conduct, or any other reason they consider material to the safety and wellbeing of those on board.

The Captain's decision is final in all matters relating to vessel operation, navigation, and guest safety. No compensation will be payable to guests where the Captain exercises their authority in good faith for safety-related reasons.

This authority is rooted in and consistent with applicable Danish and international maritime law governing the responsibilities and powers of vessel masters.

Alcohol & Substance Policy

Where alcoholic beverages are included in or made available as part of an experience, they will be served responsibly and in accordance with Danish law. Alcoholic beverages are only available to guests aged 18 years or older.

Canal Club reserves the right, and its staff are trained, to refuse service of alcohol to any guest who appears to be intoxicated, whose behaviour poses a risk to themselves or others, or who is in breach of any other provision of these Terms and Conditions.

The consumption, possession, or use of illegal substances on board is strictly prohibited and will result in the immediate termination of the experience for the guest concerned, without refund. Canal Club Copenhagen reserves the right to report such conduct to the Danish Police.

Guests are not permitted to bring their own alcoholic beverages on board, except where prior written agreement has been expressly made with Canal Club Copenhagen management.

Guest Conduct

All guests are expected to behave in a respectful, courteous, and considerate manner towards Canal Club staff, crew, and fellow guests at all times.

Any behaviour that endangers the safety of any person on board, causes distress or discomfort to other guests, damages Canal Club property, or brings Canal Club Copenhagen into disrepute will result in the immediate termination of the experience without refund and may result in further legal action.

Canal Club reserves the right to refuse boarding or to terminate an experience for any guest whose conduct, before or during the experience, is deemed unacceptable by the Captain or Canal Club management. In such cases, the affected guest will be returned to shore at the earliest safe opportunity, and no refund will be issued.

The Lead Booker is responsible for the behaviour and conduct of all members of their party throughout the booking process and the experience itself, including any children or additional guests they have brought on board.

Damage to Vessel & Property

Guests are personally responsible for any damage caused to the vessel, its equipment, furnishings, or any other Canal Club property as a direct result of negligent, reckless, or intentional acts during the experience.

In the event of damage, Canal Club Copenhagen will assess the reasonable cost of repair or replacement and invoice the Lead Booker accordingly. The Lead Booker agrees to pay any such invoice within 14 days of receipt.

Canal Club reserves the right to retain payment authorisation details provided at the time of booking for the purpose of recovering costs associated with damage caused by guests.

Liability & Disclaimer

Canal Club Copenhagen operates all experiences with due care and skill, in full compliance with applicable Danish maritime regulations, and with the safety of all guests as the foremost concern.

To the fullest extent permitted by applicable Danish and EU law, Canal Club Copenhagen shall not be liable for:

  • Personal injury, illness, death, or other harm arising from participation in an experience, except where directly and solely caused by our proven gross negligence or wilful misconduct.
  • Loss of or damage to personal belongings, regardless of cause.
  • Indirect, consequential, special, or economic loss of any kind arising from the experience or any cancellation thereof.
  • Losses arising from events outside our reasonable control, including Force Majeure events.

Guests participate in all Canal Club experiences voluntarily and with full awareness that water-based activities carry inherent risks. By confirming a booking, guests acknowledge and accept these inherent risks.

Nothing in these Terms and Conditions limits or excludes our liability for fraud, fraudulent misrepresentation, death or personal injury caused by gross negligence or wilful misconduct, or any other liability that cannot be lawfully limited or excluded under applicable Danish consumer protection law.

Canal Club Copenhagen carries public liability insurance in accordance with Danish maritime law requirements.

Personal Belongings

Guests bring all personal belongings on board entirely at their own risk. Canal Club Copenhagen is not responsible for the loss, theft, damage, or destruction of personal belongings of any kind, including but not limited to mobile phones, cameras and photographic equipment, jewellery, wallets, clothing, or other valuables.

We strongly advise guests not to bring unnecessary valuables on board and to ensure they have appropriate personal travel or belongings insurance in place before their experience.

Photography, Video & Media

Canal Club Copenhagen and its staff and contractors may take photographs and video footage during experiences for internal quality, marketing, promotional, and social media purposes. By participating in an experience, guests provide their implied consent to this use of their likeness, unless they notify the Captain or crew in writing or verbally at the start of the experience.

Guests who do not wish to appear in Canal Club marketing materials must inform the Captain or crew clearly before or at the commencement of the experience. We will make all reasonable efforts to ensure such guests are not featured in any published materials.

Guests are welcome to take personal photographs and videos during experiences for personal, non-commercial use. By voluntarily tagging, hashtagging, or sharing content referencing Canal Club Copenhagen on social media platforms, guests grant Canal Club a non-exclusive, royalty-free, worldwide licence to reshare and use such content for promotional purposes, with attribution to the original creator where practicable.

Intellectual Property

All intellectual property associated with Canal Club Copenhagen, including but not limited to our company name, logo, brand identity, website content, copywriting, imagery, photography, experience concepts, and design elements, is owned by or licensed to Canal Club Copenhagen and is protected under applicable Danish and international intellectual property law.

Nothing in these Terms and Conditions grants guests any licence, right, or permission to reproduce, distribute, modify, or use Canal Club Copenhagen's intellectual property for any commercial purpose without our express prior written consent.

Data Protection

Canal Club Copenhagen processes personal data in accordance with applicable EU and Danish data protection legislation, including Regulation (EU) 2016/679 (the General Data Protection Regulation, "GDPR") and the Danish Data Protection Act (Databeskyttelsesloven).

Complaints

Canal Club Copenhagen is committed to delivering exceptional experiences. If you have a complaint or concern about any aspect of your experience, we encourage you to raise it directly with the Captain or crew on the day, so that we have the opportunity to address it immediately.

Formal written complaints must be submitted to concierge@canalclub.dk within 14 days of the experience date, clearly describing the nature of the complaint and your booking reference. Complaints submitted more than 14 days after the experience may not be considered.

We aim to acknowledge all written complaints within 2 business days and to provide a full response within 5 business days. We take all feedback seriously and are committed to resolving complaints fairly, promptly, and in good faith.

Amendments to These Terms

Canal Club Copenhagen reserves the right to amend, update, or revise these Terms and Conditions at any time without prior notice. The most current version will always be published on our website at canalclubcopenhagen.com/legal/terms, with the effective date clearly stated.

Bookings confirmed before any amendment to these Terms and Conditions takes effect will continue to be governed by the version of the Terms in place at the time of booking confirmation.

Severability

If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be unlawful, void, invalid, or unenforceable for any reason, that provision shall be deemed severable from the remaining Terms and Conditions and shall not affect the validity, legality, or enforceability of any of the remaining provisions, which shall continue in full force and effect.

Governing Law & Jurisdiction

These Terms and Conditions are governed by and shall be construed in accordance with the laws of the Kingdom of Denmark, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or in connection with these Terms and Conditions, or any breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the Danish courts. The Copenhagen City Court (Københavns Byret) shall serve as the court of first instance.

Consumer guests located within the European Union may also choose to use the European Commission's Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr, to resolve disputes without recourse to court proceedings.
